Good luck..I filed everything on the 14th of Aug; for 485 I think the fees was 395; for EAD 180 and AP 170. all together 1490 for 2...1165 seems a little weird because first of all 1165 is not divisible by 2 :)); I guess based on old fee structure, 485 is 325 plus 70 biometric fee

Hello,
As my lawyer has used his checks to pay my 485/765/131 fees, there is no way of knowing whether the checks have been cashed. I did called my attorney a couple of times last week and he told me that checks are NOT yet cashed.
So I'm still waiting to hear from the lawyer abt the receipts.
And it looks like your package was handled at NSC itself, instead of getting transfered to TSC or CSC, hence the LIN#.
I will let you know once my receipts are in.

Let me add my 2 cents here -
1. There is no rule that H1 status expires after 1 year of no use. The key word here is H1 status.
2. If the person is in US, then he/she 60 days to start working on H1 job else apply for change of status (or leave US and re-enter on some other visa).
3. If the person is entering US on H1 visa, then he/she has 30 days to start working on H1 job.
4. Within 30 days of start working, person should get his/her first paycheck.
5. By not working on H1 job, you are out of status since Oct 1st. (there is no grace period for out status. However, out of status does NOT mean illegal presence as long as I-94 date is not expired or USCIS has made the determination that you are out of status.
6. 3/10 year bar applies for illegal presence and not for out of status.

funny thing, this SunnySurya guy happens to be from a small consulting company with 8 people out of which everyone got audited and at one point he says he does not know if his application is Eb3 or Eb2 and he is trying to figure it out.
Then he comes with filing a lawsuit against porting from EB3 to EB2

ADIT - Alien Documentation, Identification & Telecommunications System (ADIT Photo's no longer used by the USCIS )
ADIT refers to biometrics. What the approval notice is stating is that you will get your GC within 60 days or when you complete any ADIT processing that still needs to occur.
Some people are getting their GC approved without an up to date ADIT file. So the application is approved and an ADIT request is made. Once you complete it, they send you the card.
The old I-551 stamp was also refered to as an ADIT stamp, but I don't think that's what they are refering to here.
Don't worry about it, it's the standard message.
IF ADIT PROCESSING IS REQUIRED THEN IT WILL BE MENTIONED IN THE WELCOME NOTICE. THIS IS A STANDARD MESSAGE. I ALSO GOT THE SAME MESSAGAE BUT MY WELCOME NOTICE DOESNOT HAVE ANYTHING ABOUT ADIT PROCESSING. SO TAKE IT EASY.

Like my title says - Could it be a mistake on their part for EB3 I ? Was it meant to be 15th April 2002 ?
In March of This year it was 15th Oct 2001. Then it goes to U for untli Oct and now its 15th April 2001 (gone back 6 months !!!!) This seems odd for a new fiscal year with new Visa Quota however small EB3I may be - are there still that many 2000-2001 applications pre-adjudicated in the system waiting for a visa that they had to roll it back ?

Pamposh - Point is not we getting money, idea is getting it back from USCIS. Whoever paid it, USCIS got it. Moreover, money is not the only issue. There are quite a few as we listed before.
Completely agreed. It is not about money, that is just a small portion of the whole issue and it does not matter who paid it. Infact even if the employer is paying for our application he/she is not paying it for free, they pay coz we work for them so logically it could be considered our money...that is what we need to emphasize on.
Its ideal, we dont waste our energy on these.
I don't think we are wasting energy/time by identifying gaps and answering questions to folks who want to know more about what exactly are we talking about here. Moving on and gaining more and more support etc., all these things need to be done in parallel.

Folks who opened an SR and had NSC-CSC-NSC transfers, what is the format of the ref # the Cust Service Rep gave you??
I got a # of the format T1NXXXXXXXXXXXCSC format.
I also got this format. but response, came from NSC after 30 days of filing SR.
I had called in the middle to confirm whether SR went to CSC. Rep said requests will get to apprpriate service center.
the other problem is for people like us, the status says " case traansferred and pending at uscis office". I find that reps find it hard to figure out where it is pending. because of wac number, they sometimes conclude it is CSC.
the status on phone says "pending at lincoln".

I think the above statement is correct. There are 1000s of EB3 I folks in IV and they could have very well contributed a quarter or even a million bucks. My question is, what will happen after that?
