Guys,
It's almost 3 weeks today since I've opened SRs for my self and my spouse for not receiving FP notice and we haven't got any notice yet.
I want to know if some one who opened a SR for FP and did not receive any FP notice after the wait period expired, what did you do? Is taking an infopass the next step for missing FP notices or just wait and watch?

Folks, here is what I am able to gather by self employment
(1) One can be self employed
(2) 1099 or w2 - kinda tricky - most people I talked to do w2 and any profits they get after they take their salary are bonuses
(3) The job has to be legitimate - in the same or similar category - you must be doing duties that are similar in nature to your 140 petition
(4) What is meant by legitimate is - you must simply not be doing "nothing" - there must be income and you must be doing your duties.
Correct me if I am wrong

5. Job duties must match with original labor/I-140 conditions.

Any volunteer for the letter. We will need to move fast ! God knows what Oct bulletin has in store for us.
My biggest worry is that the bulletin may show retrogressed dates and the dates will stay there as it is till last quarter when visa flow will take place.

ok suri, while you work 30 hours and make money for yourself, let me take your burden and share my research with you. Here is what you have to do to see the result -
Goto -

- check box for client name
- click 'submit' button
- enter 'Immigration Voice' in the client name
- click 'submit' button
Now you see the amount spent by IV for lobbying in the Senate documents. Please do the total and let me know how much is that amount. I am not "highly skilled" like you, so I can't calculate?
Do you know anyone who spent 1/2 million on lobbying for our issues. Maybe your friends have spent that money.

Why should members do research to get this info when it can be relatively easily acquired by Quinn Gillespie & Assoc and given to core ? My lawyer sent the applications on June 1st and we have the receipts already. They cashed the checks by June 6th.

Set up a LLC company or sole proprietorship and work with an attorney. Keep the paperwork tight and upto date.

Setting up company is just the first step for Self-Employment. The key things is to demonstrate that new job is in same/similar classification and company has offered "bonafide" job, not just job on paper.
BTW, it is not necessary to have LLC. The corporate structure could be S-Corp or C-Corp also.

Zeta, congrats on ur successful landing and more so due to non-issues at the US side. I completed my landing in May, 2008 and its been about 4 weeks and my friend in Canada hasn't received the card yet. So, I'd assume its common. Yes, as u r not earning any income, there r no tax filing issues. Have u also applied for a SIN and opened a bank accnt? I've done neither. I just did the landing (was barely for about 30 mins in Canada), took a U-turn and came back to the US :). Unlike u, I used AVR to return back to US.
Yeah, I applied for an SIN card, and received a temp number as well at the same time. I didn't open a bank account however. Hope we receive the PR card soon, then at least the angle to the north is taken care of for the time being.

Agreed that H-1B has a fixed date. But from the employer standpoint, you're their "full-time, permanent" employee on H-1B, right? Because Future GC job could be same job on H-1B, only difference being on H-1B your job has fixed end date (noted by I-94), and GC job has no fixed end date, hence permanent. It does not make that current job on H-1B permanent.
Temp Job and Permannet Job can have same job title and job duties. Just like contract job and full-time job can have same job title and job duties, but one is employee of the company and other one is not.

I am in same situation who has sept 10th ND from TSC , no FP for me or my wife. I did open a SR and i got a response letter saying that either your FP has expired or clearance has not been received.. will send one by mail soon.
It has already been 45 days since the letter was dated. NO FP nothing.
Has going to IO helped anybody is getting a FP notice? That seems my last resort.
If its TSC then I do not think it will help at all. Whenever I talk to IO their only response if they are waiting for availability at local ASC.
So TSC people are out of luck.

One of my friends was a plaintiff in the lawsuit that you mention. As you mention, USCIS quickly approved all cases. So didn't the plaintiffs won the case?
I hope our potential lawsuit will have a similar effect. We file a lawsuit saying we are discriminated based on country of birth. USCIS opposes the lawsuit, but quickly approves all our 485s. We both win in that situation.
I would be happy if EB2 India gets upto Dec04. Forget EB3. Also any lawsuit is only sustainable only if its properly funded, well represented and there is wide public support if you expect the class action status. Mr Rajiv Khanna filed a lawsuit for 485 backlogs and its class action status was denied by the judge which I personally think was a biased judge and later USCIS quickly approved 485s of plaintiffs making lawsuit moot.
